Photographic Evidence of Posting
Under Zoning Code § 5-602, notice of a BMZA hearing for a variance or a conditional use appeal must be given by posting a sign in a conspicuous place on the subject property at least 21 days ahead of the scheduled hearing.
The Board requires that appellants submit photographic evidence that this required notice was posted 21 days ahead of the hearing and remained in place until the hearing date. Notice signs must be removed within 48 hours of the conclusion of the hearing.
The Board requires two submissions, each of which should be submitted through the webform.
Submission #1: 21+ days ahead of the scheduled hearing
After posting your required notice sign on your property, you must submit one photograph showing each required posted sign. The photograph(s) should show the size and location of the required sign(s) in relation to the building/lot. If more than one notice sign is required by the Code due to more than one street frontage, you must submit one photograph of each sign.
Submission #2: Friday before the scheduled hearing
You must submit a second photograph (or set of photographs) by 5:00pm on the Friday before your scheduled hearing date. The photographs should be taken on the Thursday or Friday before your hearing date (4-5 days before the hearing date).
With this second set of photos, you must also submit a signed certificate of posting. The certificate of posting affirms that the appellant has read all of the instructions and that the sign has been properly posted and maintained in accordance with the instructions.
If you do not submit the required photographs and certificate of posting before the deadline, your hearing will be administratively postponed to a new date, which you will need to arrange with BMZA staff.
